1. Who these Terms are with

These Terms and Conditions (“Terms”) are a contract between you and LUNEXLAB OÜ, registry code 17218832, registered office Harju maakond, Tallinn, Kesklinna linnaosa, Tornimäe tn 5, 10145, Estonia (“Fubble VPN”, “we”, “us”). They govern your use of Fubble VPN software (iOS, Android, Windows, macOS, and any other client we publish), our VPN network, accounts, and the website https://fubblevpn.com (together, the “Services”).

Related documents, which form part of this contract where they apply: Privacy Policy, Cookies Policy, and the End-User License Agreement.

BY CREATING AN ACCOUNT, INSTALLING THE APP, PURCHASING A SUBSCRIPTION, OR USING THE SERVICES, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICES.

If you use the Services on behalf of an organisation, you confirm you have authority to bind it. If you are a consumer in the EU/EEA/UK, nothing in these Terms takes away mandatory rights you cannot waive under the law of your country of residence.

2. The Service

Fubble VPN provides encrypted virtual private network access so that your device can send internet traffic through our servers. We operate a no-logs VPN on Fubble-operated servers: we do not store or track your browsing, traffic content, DNS queries, or connection history that would identify what you did online. Details are in the Privacy Policy.

We do not guarantee that any particular website, app, streaming catalogue, or game will be reachable or geo-unblocked. Third parties may detect or block VPN addresses. Speeds depend on your local network, the destination, and congestion.

2.1 On-demand servers and public fallback

We do not promise a dedicated Fubble-operated server in every country or city at all times. If you choose a location where we do not currently have capacity, we may:

  • Roll out a new Fubble-operated server for that location, typically within minutes; and/or
  • Temporarily offer a connection to a publicly available open VPN endpoint so you can get online while the dedicated server is being provisioned.

The public fallback is optional. You may refuse it or disconnect at any time. Public endpoints are not operated by us, are provided “as available”, and do not carry our no-logs, security, or uptime commitments. We are not responsible for logging, filtering, or abuse policies of those third-party operators. When a dedicated Fubble server is ready, you can switch to it in the app.

We may add, move, or retire locations, protocols, or features without reducing the core paid entitlement you already purchased for the remainder of the paid term, except where a change is required by law or for security.

3. Eligibility and accounts

You must be at least 16 years old (or the age of digital consent in your country, if higher) and legally able to enter this contract. Where local law requires 18, that age applies.

You may need an account (email, Apple, Google, Telegram, or another method we offer). You are responsible for credentials and for activity on your account. Notify us at [email protected] if you believe the account is compromised. You must provide accurate information and must not impersonate others or create accounts by automated means.

The website may be browsed without an account. Some features (licence restore, device list, support history) require sign-in.

4. Licence

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the Fubble VPN client on devices you own or control, and to use the VPN network, solely in accordance with these Terms and the EULA. We and our licensors retain all intellectual property in the Services. You may not copy (except for a reasonable backup of the client), modify, reverse engineer (except to the extent that mandatory law allows interoperability), rent, scrape, or resell the Services, or remove proprietary notices.

Open-source components bundled with the client are licensed under their own licences, which prevail for those components.

5. Acceptable use

You may use the Services only for lawful purposes. You agree that you will not, and will not assist others to:

  • Commit or facilitate crime, including fraud, ransomware, child sexual abuse material, trafficking, or terrorist content
  • Attack, scan, or overload networks (including DDoS, port scanning of third parties, or brute force) except on systems you are authorised to test
  • Send spam, phishing, or unsolicited bulk messages
  • Infringe copyright, trademarks, or other third-party rights
  • Interfere with the Services, other users, or our infrastructure; share your account beyond the device limit of your plan; or resell access
  • Use the Services in a country or for a purpose where VPN use is prohibited, or in violation of export control or sanctions (including EU, UN, and US restrictions)
  • Attempt to obtain logs or user data of other customers

We do not monitor the content of your VPN traffic on Fubble-operated servers. That does not authorise illegal use. We may suspend or terminate access if we reasonably believe these Terms or the law are being violated, based on account-level signals, abuse reports, or legal process — not by inspecting your browsing history, which we do not keep.

You are solely responsible for complying with the laws of the place where you use the Services, including local rules on encryption and VPN use.

6. Subscriptions, trials, and EU consumer rights

Paid plans, prices, taxes, device limits, and billing period are shown at checkout in the app or on the website. Prices may include VAT as required. We may change prices for renewal terms; we will give reasonable notice where the law requires it.

In-app purchases are processed by Apple, Google, or another store you choose. Their payment terms apply to the charge. To cancel auto-renewal, use the store subscription settings (for example Apple ID subscriptions or Google Play subscriptions). Deleting the app does not by itself cancel a store subscription.

If a free trial is offered, its length is shown before you start. Unless you cancel before the trial ends, the paid plan may begin automatically as disclosed at sign-up.

14-day withdrawal (EU/EEA/UK consumers)

If you are a consumer and you buy a subscription directly from us (not solely through an app store that handles the contract), you may have a 14-day right of withdrawal under the Consumer Rights Directive. For digital services that start immediately, we will ask for your express request to begin performance and your acknowledgement that you lose the withdrawal right once the service has fully begun. Store purchases follow Apple’s or Google’s refund rules, which you should use first for those transactions.

Refund requests we control can be sent to [email protected]. Statutory rights remain unaffected.

7. Privacy and data processing

We process personal data as described in the Privacy Policy. In short: we do not log VPN traffic on Fubble-operated servers; we do not sell your data; the apps use Firebase and Google Analytics only for aggregated product statistics. Public fallback endpoints (section 2.1) are not covered by our no-logs commitment.

By using the Services you acknowledge that Policy. Where the law requires consent (for example certain cookies or analytics), we will ask for it separately. Consent is not a condition of the paid VPN itself.

8. Availability, changes, and support

We aim for high availability but do not warrant uninterrupted, error-free, or unlimited-speed access. Maintenance, attacks, upstream failures, or law may interrupt the Service. We may modify or discontinue features. If we discontinue the paid Service entirely, we will, where reasonable, refund the unused prepaid portion of a term we billed directly.

9. Third-party services

The Services may link to or rely on third parties (Firebase, Google Analytics, app stores, Telegram sign-in, public VPN endpoints). Those parties have their own terms and privacy notices. We are not responsible for their content or independent processing, except where the law makes us liable as a controller or for our own processors.

10. Warranty disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”. WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE VPN WILL HIDE YOU FROM EVERY ADVERSARY, THAT ENCRYPTION CANNOT BE BROKEN, OR THAT YOU WILL OBTAIN ANY PARTICULAR IP GEOGRAPHY.

If you are an EU/EEA/UK consumer, we supply the Services with reasonable care and skill and in conformity with the contract. Statutory guarantees for digital content and services remain.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICES IS LIMITED TO THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (OR, IF GREATER AND REQUIRED BY LAW, THE MINIMUM NON-EXCLUDABLE AMOUNT).

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, wilful misconduct, or any liability that cannot be limited under applicable law — including mandatory consumer and product-liability rules in the EU/EEA/UK.

You are responsible for your use of the network, including use of any public fallback endpoint you choose to connect to.

12. Term and termination

These Terms apply until you stop using the Services or we terminate them. You may stop at any time and delete your account by request to [email protected] or, where available, in the app. Cancel store billing separately.

We may suspend or terminate immediately for material breach, illegal use, non-payment, sanctions risk, or if we discontinue the Services. If we terminate for convenience and you have prepaid unused time billed by us, we will refund a pro-rata amount. If we terminate for your material breach, we may refuse a refund except where consumer law requires otherwise.

After termination, your licence ends. Sections that by nature should survive (including IP, acceptable use acknowledgements, disclaimers, liability, and governing law) survive.

13. Changes to these Terms

We may update these Terms. We will change the “Last updated” date and, for material changes, give notice via the website, the app, or email. If you do not agree, stop using the Services and cancel the subscription. Continued use after the effective date constitutes acceptance, except where consumer law requires an explicit opt-in.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of Estonia, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.

If you are a consumer habitually resident in the EU/EEA or the UK, you also enjoy the mandatory protections of the law of your country of residence. You may bring proceedings in the courts of Estonia or of your place of residence. You may use the European Commission’s ODR platform ec.europa.eu/consumers/odr where it remains available; we are not obliged to use a specific ADR entity unless required by law.

If you are not a consumer, exclusive jurisdiction lies with the courts of Tallinn, Estonia, without prejudice to our right to seek injunctive relief elsewhere.

15. Miscellaneous

If a provision is unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganisation or sale of the business, with notice on the website. These Terms, together with the Privacy Policy, Cookies Policy, EULA, and checkout disclosures, are the entire agreement for the Services. Partner or reseller extra terms cannot reduce our rights unless we agree in writing.

Export: you represent that you are not a prohibited person and are not located in a comprehensively sanctioned jurisdiction.
